Rainbow Railroad Releases Important Report Detailing Taliban Treatment of LGBTQI+ Persons

On December 19th, Rainbow Railroad released “No Safe Way Out: Human Rights Violations Against LGBTQI+ people under the Taliban”. The report provides qualitative analysis based on 1,739 requests for help submitted to Rainbow Railroad between August 2021 and August 2022. Accounts from individuals throughout the report describe coordinated and repeated tactics used by the Taliban to target and persecute LGBTQI+ communities. For the first time based on requests for help, Rainbow Railroad is able to provide details on the extreme violence towards LGBTQI+ people and those who support them perpetrated by the Taliban.

These findings corroborate and update earlier reports of abuses against LGBTQI+ people by the Taliban.

“In writing this report, it became clear how all-encompassing the threats are towards LGBTQI+ people in Afghanistan under Taliban rule,” said Kathryn Hampton, the primary author of the report and Head of Impact at Rainbow Railroad. “This report is a jarring summary of violence faced by individuals suspected of being members of the LGBTQI+ community – violence they’re facing just for being who they are, or loving who they love. Conducting this research was heartbreaking and deeply alarming. Our recommendations are even more urgent following disturbing recent reports by Taliban officials of public floggings of LGBTQI+ people before thousands of onlookers.”

According to individuals who have reached out to Rainbow Railroad for help, the Taliban is targeting LGBTQI+ people due to their sexual orientation, gender identity, expression, or sex characteristics. Individual accounts included in this report detail multiple tactics used by the Taliban to identify and find LGBTQI+ people, including identifying them from social media photos or videos, during searches of belongings and cellphones at checkpoints, and through emboldening community members to surveil and report on LGBTQI+ people. The report details how individuals are encouraged to report on their own friends, colleagues and family members if they are suspected of being LGBTQI+, or risk facing punishment themselves.

A number of LGBTQI+ people reported being beaten and subject to physical violence by the Taliban both inside of, and concerningly, outside of detention settings, either in their homes during an unlawful search, or in public places to ‘make an example’ of members of the LGBTQI+ community. Rape and sexual violence were mentioned in many requests for help, including sexual assault by family,community members, and members of the Taliban themselves in an environment of impunity.

Rainbow Railroad also reviewed several documents, reportedly issued by Taliban officials, which indicate that these violent incidents may even be coordinated actions based on official Taliban policies.

“This report demonstrates the extreme risk that LGBTQI+ Afghans are facing everyday. Those reaching out to Rainbow Railroad are in serious danger,” said Rainbow Railroad Executive Director Kimahli Powell. “We have hundreds of LGBTQI+ Afghans who are at severe risk ready to travel. It’s up to governments, including the governments of Canada, the United States, and the United Kingdom, to partner with us to respond urgently.”

In the first year of Taliban rule, from August 15, 2021 until August 22, 2022, Rainbow Railroad received 3,797 requests for help from LGBTQI+ Afghans. Rainbow Railroad has facilitated the relocation of 247 Afghans for resettlement to safer countries since August 2021, and have also provided 648 Afghans with financial assistance, shelter support, mental health support, and other forms of assistance.

The 2022 LGBTQ Community Center Survey Report, prepared jointly by MAP and CenterLink and published every two years, provides an overview of local lesbian, gay, bisexual, transgender, and queer (LGBTQ) community centers, including their capacity, their programs and services, the people they serve, and their major challenges and opportunities.

This year, the report surveyed 208 centers located in 45 states, the District of Columbia, and Puerto Rico, and provides a crucial snapshot of the centers that provide vital services, programs, and advocacy for LGBTQ people.

ADL and GLAAD Partner to Counter Anti-LGBTQ+ Extremism and Hate

ADL (the Anti-Defamation League) and GLAAD, the LGBTQ media advocacy organization, today announced a new partnership to counter anti-LGBTQ+ extremism and hate in the United States. The two organizations are joining together to sharpen their focus on hate and extremism targeting the LGBTQ+ community, which has experienced thousands of hate crimes in recent years, according to the FBI. This partnership will increase ADL and GLAAD’s ability to monitor, expose and disrupt anti-LGBTQ+ hate by hiring a new analyst dedicated to tracking and countering threats against the LGBTQ+ community.

“The LGBTQ+ community is under attack in the United States,” said Oren Segal, Vice President of the ADL Center on Extremism. “ADL has tracked disturbing incidents and trends in anti-LGBTQ+ hate in person and online in just the last few months, including physical violence, death threats, intimidation, doxing, conspiracy theories, misinformation and more. We are grateful to partner with GLAAD, an organization that has led the fight for LGBTQ+ equality for decades, to support a new role dedicated to understanding and countering this pernicious threat.”

The partnership will enhance both organizations’ abilities to track extremist activity and hate incidents, produce reports and resources to educate key stakeholders and the public about trends and developments, and alert law enforcement and community organizations to threats targeting LGBTQ+ individuals and institutions.

“ADL is a true leader in tracking and stopping hate and extremism and this is an urgent time to protect the LGBTQ community by further growing this impactful work. LGBTQ people face alarming and disproportionate levels of hate and harassment on social media and it’s rapidly moving offline,” said GLAAD President and CEO Sarah Kate Ellis. “You can draw a direct line from anti-LGBTQ content and accounts on social media to real world violence: from extremists showing up at drag shows to vandalism at LGBTQ community centers to bomb threats being called into children’s hospitals that care for transgender youth. This new partnership will help GLAAD and the entire LGBTQ movement in identifying and reporting the growing rates of anti-LGBTQ violence before it happens.”

ADL has worked for decades to protect the LGBTQ+ community, including filing amicus briefs encouraging courts to end discrimination, promoting legislation like the Equality Act and playing a leading role in securing enactment of the Matthew Shepard and James Byrd, Jr. Hate Crimes Prevention Act (HCPA) in 2009 – the first time gender identity was included in a federal civil rights law.

For nearly 40 years, GLAAD has been at the forefront of cultural change, accelerating acceptance for the LGBTQ community. The GLAAD Media Institute tells LGBTQ stories that create change and is a go-to resource on LGBTQ representation for leading journalists, brands, entertainment, gaming creators, elected officials, and other notables. GLAAD’s Social Media Safety Project produces an annual Social Media Safety Index, which this year gave failing grades to five leading social media platforms on LGBTQ safety. The program works with platforms on LGBTQ policies and enforcement, such as TikTok’s recent move to prohibit promotion of conversion therapy and to protect transgender users from targeted misgendering and deadnaming.

Philadelphia takes action to support Trans & GNC youth

PHILADELPHIA — Effective July 11, 2022, the Philadelphia Commission on Human Relations (PCHR) has enacted regulations that expand legal protections for transgender and gender nonconforming youth. The regulations create affirmative obligations for institutions serving youth to ensure that their environments are free of discrimination. The legislation requiring these regulations was introduced by Councilmember Helen Gym (At-Large) and passed by City Council in 2019 in conjunction with two other bills designed to promote dignity, safety, and inclusion in the City of Philadelphia.

The regulations also:

  • Require that all institutions serving youth use the name and pronouns that correspond to a youth’s identity.
  • Require institutions to take reasonable steps to prevent and promptly correct any derogatory or offensive langue used in communication with or in reference to a transgender or gender nonconforming youth.
  • Ensure privacy and confidentiality of the transgender or gender nonconforming youth’s identity.
  • Require institutions provide access to restrooms, locker rooms, and dressing rooms that correspond to a transgender or gender nonconforming youth’s identity.
  • Require institutions post a written policy of non-discrimination and conduct regular training to prevent, identify, and respond to bullying, harassment, and discrimination against transgender and gender nonconforming youth.


“I am extremely proud of this work because these regulations demonstrate the City of Philadelphia’s commitment to ensuring supportive and inclusive environments for all children,” said Kia Ghee, Executive Director for Philadelphia Commission on Human Relations. “At a time when constitutional protections feel less certain, these regulations build upon the antidiscrimination protections provided in the Fair Practices Ordinance and emphasize the City’s commitment to protecting children and youth who are much more likely to be subject to unlawful harassment in school and other institutional settings.”

“With the disturbing and increasing amount of anti-trans legislation that targets trans youth, these reforms represent welcome, needed progress and are just one of the many reasons that Philadelphia is consistently recognized as one of the most LGBTQ-friendly cities in the country,” said Celena Morrison, Executive Director of the Office of LGBT Affairs. “We will continue to support our trans and gender nonconforming communities in every possible way.”

Ben & Jerry’s Uses Campaign to Support Trans Youth and Highlight the Equality Act

In the wake of a recent spate of hateful, anti-trans legislation in states across the nation, Ben & Jerry’s has launched a billboard campaign to stand in solidarity with trans youth and their families who have been targeted by the latest wave of attempted new laws. In partnership with the National Center for Transgender Equality (NCTE), the billboards are targeting four states: Florida, Texas, Georgia, and Virginia, all of which have introduced anti-trans legislation in recent months. The message on the billboards, placed within each state’s capital, reads “We Stand with Trans Youth and Those Who Love Them.”

“At a time when many politicians are criminalizing access to health care for trans youth — in addition to other efforts to marginalize them — we felt it important to make a public stand in support for them and their friends and families. We see them, we hear them, we stand with them,” said Maroni Minter, US Activism Manager for Ben & Jerry’s. “After years and years of progress in the LGBTQ+ and trans community, this wave of regressive legislation is trying to take us backwards not forward. In the face of this reality, it is more important than ever that we not remain silent.”

This initiative, launching May 23rd, is part of Ben & Jerry’s ongoing body of work around advancing justice for those in the LGBTQ+ community, and is in collaboration with their long-time partner, the National Center for Transgender Equality, who have asked for businesses to stand up loudly and clearly in support of the trans community at this time.

“Through no fault of their own, transgender youth are under attack by some of the most powerful people in the states where they live,” said Rodrigo Heng-Lehtinen, Executive Director of the NCTE. “Transgender kids deserve to be seen, to be loved, and to be treated with respect. These laws will cause tremendous pain to many families, and even worse, they give permission to other people to harass and discriminate against transgender people. There will be lasting consequences on young people and their families, who are all just trying to live their lives. These laws are mean, hateful, and aimed directly at kids. We are grateful to Ben & Jerry’s for standing with transgender young people and their families, and for reminding us all that we are not alone.”

On top of the four states included in the campaign, 31 other states have seen legislative activity that seeks to marginalize the transgender community, most specifically designed to affect trans youth. Additionally, Ben & Jerry’s will also be placing a newspaper ad in their home state of Vermont. The state has been dealing with its own spate of anti-LGBTQ+ activity, including the recent murder of a trans woman, vandalism of a local LGBTQ+ community center, and hateful messages targeting local school staff for hosting workshops about gender equity.

Measure to Establish Human Rights Sanctuary in District Introduced

In anticipation of a Supreme Court ruling that would criminalize rights long held by women and our LGBTQ community, today, Councilmember Brianne K. Nadeau, along Chairman Phil Mendelson, Councilmembers Anita Bonds, Charles Allen, Vincent Gray, Christina Henderson, Janeese Lewis George, Elissa Silverman, Robert White, and Kenyan McDuffie, introduced the Human Rights Sanctuary Amendment Act of 2022.

“It is rare that we get a sneak peek into a court decision that will have such a devastating impact to our residents, and it’s clear from the draft opinion that even more than the right to abortion is at stake,” said Nadeau. “Under Samuel Alito’s regressive, political, results-oriented reading of the Constitution, all substantive due process and equal protection rights, such as the rights to marriage, non-procreative sexual conduct, and the use of contraception are under threat. With this legislation I am hoping we can solidify the rights of our own residents as well as those who may now be forced to travel here to preserve their own.”

Earlier this week, Politico circulated a draft opinion in Dobbs v. Jackson Women’s Health Organization suggesting that the Supreme Court will eliminate the constitutional right to abortion later this year. At a press conference with other government representatives on Tuesday, Nadeau promised District residents that she would take legislative action to defend the rights protected by Roe v. Wade.

Nadeau has been involved with Planned Parenthood since high school, and recounted in the press conference Tuesday that it was the March for Women’s Lives of 2004 that inspired her to change her career focus to government and political work.

The proposed legislation would prevent the District from cooperating with investigations in furtherance of proceedings that seek to impose civil or criminal liability for the protected conduct identified in the statute. It also creates a private right of action against parties who successfully bring Texas-style bounty claims against others for engaging in protected conduct.

The bill is modeled, in part, on Connecticut’s recently passed Reproductive Freedom Defense Act.  It protects the rights of District residents to live with whom they please, love whom they love, and control their reproductive destinies. It makes the District a safe haven for trans youth who need gender-affirming care, LGBTQ+ individuals who need to preserve their families, and all people who need reproductive freedom to flourish as meaningful participants in American life.

“While I am hurt and horrified by the assault on human rights perpetrated by the Supreme Court,” Nadeau added, “I am resolved to do all that I can to protect women and other District residents whose liberties are endangered.”

Air Force Offers to Relocate Families Impacted by Anti-Trans Legislation

Various laws and legislation are being proposed and passed in states across America that may affect LGBTQ Airmen, Guardians, and/or their LGBTQ dependents in different ways.
 
The Department of the Air Force has assignment, medical, legal and other resources available to support Airmen, Guardians and their families.
 
“The health, care and resilience of our DAF personnel and their families is not just our top priority – it’s essential to our ability to accomplish the mission,” said Under Secretary of the Air Force Gina Ortiz Jones. “We are closely tracking state laws and legislation to ensure we prepare for and mitigate effects to our Airmen, Guardians and their families. Medical, legal resources, and various assistance are available for those who need them.”
 
If service members or their families need help with screening, treatment, or mental health support for medical concerns, they should start with DAF medical treatment facilities, according to DAF officials. The MTFs can also assist with navigating challenging life circumstances.
 
The Exceptional Family Member Program is another resource available for all active component Airmen and Guardians to assist families with special needs during the PCS process to include navigating medical, legal, and educational support for dependents during relocation.
 
“As is the case with all of our family members, if the support a family member needs becomes unavailable, commanders can work to get the service member to an assignment where their loved ones can receive the care they need,” Jones added.
 
Installation legal offices are another free source of information for personnel who need assistance navigating new and existing local laws. While installation legal personnel cannot represent Airmen, Guardians or their families in court, they can provide vital advice and counsel.
